The Centers for Medicare and Medicaid Services (CMS) January 2022 policy statement which says the agency considers non-submit/evidence based MSAs “as a potential attempt to shift financial burden” to Medicare reignited the debate over submit vs. non-submit MSAs. The startling addition to its WCMSA reference guide left many questions in its wake and triggered many payers, along with injured workers and their attorneys, to reconsider the choice to avoid the CMS MSA review and approval process. The panel will present data on post-settlement Medicare claim denials for injury related care and provide a flowchart discussion of how to determine the best course of action with settlements involving MSAs.
