“Darn I wish they’d…” is neither an effective nor even responsible posture for stakeholders observing (and usually being at the wrong end of) proactive claimant/applicant advocacy at both the legislative and appellate levels — advocacy which essentially shapes that thing we all do: the workers’ compensation law. Yet, the industry side of the claims industry is often behind the employee/claimant’s bar in identifying and pursuing goals through legislation, regulation, and appellate practice. Let someone else do it is usually the default mode, but should it be?

This panel will identify reasons why — coupled with concrete recent successes — industry can and should work to better identify and proactively protect its interests through coordinated programs harnessing significant resources readily available. Specifics are provided for every facet of a practical, readily implementable approach including: Creating a state or national legislative program identifying and selecting issues to pursue; Se- curing buy-in and participation from internal and external powers necessary for success; Regulation or legislation? – how to distinguish and address both; Paying for the program – Amicus programs; Avoiding conflicts and infighting; and finally, DO NOT MAKE BAD LAW – How to separate realistic wishes from wishful thinking.
