Understanding the Medicare Secondary Payer (MSP) program is critical to anyone involved in the workers’ compensation claim resolution process. But understanding the details of exactly how the program works, in what sequence, and why, is critical to successfully navigating any MSP claim. WCI is pleased to welcome a leading government official from the Centers for Medicare and Medicaid Services (CMS) with responsibility for management of the program to address the MSP program generally, and the claims resolution process specifically. The past decade has witnessed an explosion of interest in the Medicare Secondary Payer program. Yet, unknown to most in the claims community, there is an even larger program that may impact claims in the coming years – Medicaid, and the Medicaid Third Party Liability program. In fact the TPL laws can have as much impact on the claims resolution process as the federal Medicare law. This is because there are far more Medicaid beneficiaries in the country than Medicare beneficiaries (74 million compared to 55 million), and states are increasingly gaining insight into ways to identify claims and pursue recoveries. Although the historic legal limits on the states to pursue claims has diminished state interest, those legal restrictions are falling away, and recent changes threaten to make TPL “the next MSP” for the claims community.

Come join us to take a deep dive into exactly what the TPL laws are, how they operate, what the states are required to do, and how states are increasing their pursuit of TPL claims against settling parties. The session will also explore how the claims community has navigated the issues to date, and how the community will need to adjust to the emerging “new normal” of increased state recovery activity.
